Sometimes love disappears from a relationship like that cloud. When the relationship begins, everything looks ok. The communication is great. Not only verbal but also non-verbal communication between the partners is excellent. Slowly the rot sets in and there come a time when they stop communicating except when needed. The communication becomes need based. Earlier it was love based. What is the difference between need based and love based communication? Relationship and communication - In love based communication the partners talk to each other about everything on the earth. What is required to keep the partnership together is the communication limit and nothing beyond that. It may revolve around bill payments, and other such talks. What you may need instead is to reward and treat yourself occasionally. Depriving yourself of food you love day in and day out will only leave you grumpy, not to mention, unsatisfied. So 20 percent of the time - treat yourself. That way, you'll have something to look forward to and you won't feel as deprived the rest of the time. It's the only sweet I'm allowing myself to indulge in today. I'm savouring the moment by letting it melt instead of chewing it. If you had the will to go on a diet, the fact that it steadily becomes less and less effective makes it even harder to stick to it. It is thought to have medicinal properties that can be helpful to those suffering from a myriad of ailments, including arthritis, nausea, motion sickness, headaches, and perhaps even types of heart disease. In the United States the use of herbs as medicine is still considered as alternative, but in places such as China, the Caribbean, India, parts of Africa and Europe ginger is widely accepted as a healing herb. The history of ginger is quite fascinating. The Sanskrit name for ginger is srngaveram, which translates to horn root. This is believed to be because of the appearance of the ginger root, which does bear a resemblance to an animals horn. At some point in history ginger disappeared, but it is thought that Marco Polo brought it back with him after his extensive travels and it then became a delicacy in Europe. Most of the supply of ginger comes from Jamaica, India, Africa, and China. Ginger grows in the wild in Jamaica and other islands of the Caribbean because the tropical climate offers the best growing conditions. Ginger in the wild produces flowers when the herb is at its most ripe stage. Queen Elizabeth I loved the taste of ginger and encouraged her cooks to experiment with it. The gingerbread man is said to have been the direct outcome of this experimentation. Ginger has been used most commonly to treat gastrointestinal maladies such as nausea, abdominal bloating, diarrhea, uncontrollable vomiting, heartburn, intestinal gas resulting in excess flatulence, and colitis. Many believe that ginger can help with these ailments because it contains properties thought to strengthen the muscle tone in the intestinal tract. Herbalists use ginger extract to decrease inflammation, which is a leading cause of many ailments including osteoarthritis and rheumatoid arthritis, bronchitis, dermatitis, and ulcerative colitis. Studies are not at all conclusive, but many people prefer to use a natural remedy instead of taking ibuprofen or other traditional medication. Use of ginger to treat motion sickness appears to be at least somewhat effective but more studies need to be conducted and analyzed. As far as heart disease is concerned, it is unclear whether or not ginger can be used successfully to lower cholesterol. It is simply to early to make an intelligent comment on this type of medicinal use of the herb. Ginger appears as a knotted root with an underground stem known as a rhizome. It consists of volatile oils (somewhere between 1 and 4%), as well as pungent compounds known as gingerol and shogaol. It is these compounds that are thought to be responsible for the healing properties of ginger for nausea and vomiting. You can find ginger in the produce department as a fresh or dried root. Ginger is also available as a powdered extract, in capsule form, or as an oil. You can use ginger to prepare a tea or use it as a cooking spice to prepare breads, cookies, or as an ingredient in vegetable dishes. It is always wise to do your own research and talk to your physician before supplanting ginger, or any other spice or herb, with prescribed medications. Many health food stores have herbalists on staff that can also answer any additional questions you may have. As with all things in your life, moderation is the best choice. How To Find The Motivation You Need To Lose Weight...

By George Black Before you start a weight loss (fat loss) program, it's important to know WHY you want to do so. If you take care of the "why", the "how" will usually take care of itself... Don't just say "I want to lose 40 pounds". That's just a number. WHY do you want to lose weight? Will you be able to wear those clothes that you feel comfortable in? Will you look more attractive to the opposite sex? Will you be a great role model for your kids? Will you have more energy? Why do you want to go through a fat loss system and not just sit on the couch watching "Desperate Housewives"? You need to be clear on that. That will give you the fire you need to keep going. Write your goals down and stick them to a place you can see them every day. Your fridge, your PC, your wallet or whatever. DO IT. People tend to forget easily. Studying for the GMAT: The Best and the Worst

Although it may seem like a daunting task at first, your undergraduate degree and related activities should have adequately prepared you for the test, and really you should probably look at studying for the test as reviewing what you already know rather than learning something completely new. The Official Guide for GMAT Review Published by ETS, the people who make the test, this is definitely the best study book available. You can order the book used from Half. com for just over $20. The book uses past test questions, and many times the questions on the GMAT are similar to the previous tests; thus, you may find that many of things you study will appear on the test almost word for word. The practice test software is essential for learning to take the test well and quickly. Kaplan Kaplan offers both a book and a class to help you prepare for the GMAT. The test is a great resource and certainly a needed addition to the ETS book. There are several hints and tricks that the test makers don't want to reveal, but that Kaplan happily shares. Now, about the classes. I know Kaplan will hate me for this, but I just don't think they're worth your money. The GMAT is a fairly straightforward test and spending thousands on a class will probably not make that much difference in your grade. If, however, you are a student who has difficulty reading something and learning it well, then the class may benefit you. Consider your own style and study strategies and make the best decision for you. Princeton Review The Princeton Review also publishes a study book for the GMAT. Their books are truly exceptional and a must have as you get ready for the test. If it sounds like three books is just too much to buy, split it with a friend. You buy the Kaplan and they buy the Princeton Review or vice versa. Both of you should get the official guide, though, since it's really your best source for real test questions. Pace Yourself As you study for the GMAT, pace yourself. Don't do it all in one weekend, but the test isn't hard enough to warrant a year of study either. Keep yourself on target by doing a chapter or two a week and maybe a practice test over the course of a month or two. Study with Friends Studying with friends can make all the difference in your test score. You may not get as much done at a time when studying with friends, but you will be likely to study more often when you're having fun. You can also put together an official study group and see if one of your professors will help you study. They want you to do well as it reflects on them too, so don't be afraid to ask - there's a good chance that they'll say, "Yes." Final Thoughts Buy the best books, pace yourself, and study with friends, preferably in a professor-supervised study group. Would you like a water garden with as little maintenance as possible?

What about durability and lasting esthetics?
Are you concerned about possible liability regarding safety and regulations? These are only a few of the many questions you should find answers to prior to constructing or investing a water garden. There exists a community of gold diggers who have discovered that their picks and shovels can now be used in mining a new treasure: rubber liner ponds and waterfalls; fast, easy and extremely profitable. Developing a Great Relationship with Your Boss

By Scott Brown We usually write about how to get interviewed and then get hired for the best job. But this weeks tip is about what to do after that happens. Finding a job is largely a sales process finding prospects (finding jobs), qualifying those prospects further (interviewing) and closing the sale (getting hired). Good salespeople know the sales process does not end when you close the deal. It continues after that as post-sale customer management. In the career world, this translates into post-hire boss management. When salespeople make a sale, they know if theyre going to get maximum value out of the account in terms of future business with the customer and getting referred to other customers, they need to have a strong post-close relationship. If you can adopt this kind of attitude with managing your boss, youll be well equipped to move ahead in your career. Learn the culture The first thing you need to do after you get hired is keep your eyes open. If you want to know how things are done around your new office, just look around. Your first few weeks should involve a lot of listening, learning, and just plain watching. Find a trusted co-worker who you can ask questions of about how things work around here. Once you understand how things work and what is expected of you, youll have a much better time producing it. Manage Expectations Salespeople often talk about managing expectations. This is a very important concept to keep in mind when developing the relationship with your boss. If you dont know what your boss expects of you, youre on track to a bad relationship with them. Find out what your bosss short-term and longer term expectations are for you, and confirm it with them by expressing it in your own words. This is the best way to make sure youre on the same page. When it comes to operational issues of getting tasks done, its always better to under-promise and over-deliver than it is to over-promise and under-deliver. Even if youre sure you can get Project X done by Wednesday, give yourself some breathing room by telling your boss it will be done Thursday or Friday. If you get it done before Thursday or Friday, your boss will be pleasantly surprised and will think of you as a professional who budgets the time necessary to get work done. However, if you promise Wednesday and get it done Thursday, your boss will think of you as careless, unprofessional, and disrespectful. Make Your Boss Feel Comfortable You want your boss to think of you as their kind of person. One way to do this that many people overlook is to adjust your personal style slightly so its not incongruent with theirs. If your boss wears suits to work but you wear khakis, he or she may be less likely to think youre their kind of person. It works the other way around too: if your boss wears khakis to work but you wear a suit, he or she will also think youre not on the same wavelength. Get a feel for how your boss likes to interact with people. Does he or she want just the facts, maam or does your boss prefer to joke around a little? Whatever their preference, if you dont adopt your style somewhat to theirs, it could cost you. If you dont, you can still do well in your position, but when a promotion becomes available or its time to consider raising your salary, your boss is going to consider whether youre their kind of person or not. Anticipate Your Bosss Needs Most people know this but it doesnt hurt to mention it anyway. Bosses dont like to have to ask for things, and they hate having to ask twice. If they have to ask twice, they see it as a sign of disrespect that you didnt comply with their first request. On the other hand, if you produce what they want before they ask for it, it will go along way to making them feel respected and valued. A great way to make a real impression on your boss and the company in general is to take the initiative at all times. Dont wait to be asked to do something you know you could or should do. This doesnt mean you should take on other peoples projects or try to show people up. What you can do however, is notice when small tasks need to be done and go ahead and do them. How Unique Is Your Business? A Competitor's Dilemma

By Gustavo Partal In our efforts to study our competitors we run the risk of marketing just like they do. This is bad news if our competitors are terrible marketers; which is the case in most cases. The emulation of competitors is more common than you may think. Most business owners dont even realize they are doing it. Its a phenomenon, where inbreeding of similar marketing strategies produces equally boring and stale results. As an example, take your local Yellow Pages Directory and turn to any section populated with advertisers within the same industry. It can be automobile dealerships, attorneys, or doctors. Now, study a few pages. You will immediately start to see a common theme, a similar pattern a pattern of boring uniformity. The great majority suffers from the me too syndrome. The prospect looking for services cant tell why she should but from advertiser A or B. It seems like the only one that benefits here is mostly the sales rep that sold the ad and the editors of the book. This can also be seen in the way different industries market their products and services. Have you noticed that each industry has a very particular way to market? Look at your industry. Do you and your competitors market in just about the same way? Have you also noticed that when some brave soul wants to innovate and market in a way different from the industrys norm, he is considered a heretic. . . condemned to burn at the stake of the boss editing pen? I call this phenomenon marketing paralysis. Its the inability to make the necessary changes in order to improve marketing results; the inability to break loose from the business as usual and the its always been done that way mindset. There is a hidden danger when you analyze your competitors in your industry. The hidden danger is overanalyzing and in the process, becoming just like them accentuating the marketing paralysis. So, why should you study your competitors? There are six key element to consider when analyzing your competition; and none has anything to do with the emulation of your competitors marketing methods. Au contraire! Read on, mi amigo. . . 1. The Reference Point
Establish which is your position within the brand ladder in comparison to your competitors. According to Al Ries and Jack Trouts book, The 22 Immutable Laws of Marketing, the law of the ladder is at play. For each rung of the ladder, there is a brand name. Although you want to be first in the prospects mind, the battle is not lost if you fail here. This is why you need to know what is your reference point; that is, your position on the ladder. This will help you select the correct marketing strategies. 2. The Price point.
Do not get hung-up on pricing. Know your product and what you want to achieve. If you are positioning yourself as the best, with the top-of-the-line product or service, then your price must reflect it. Knowing price levels from your competitors simply helps reinforce your position. If your competitor is offering just as much value as you do, but for less; then, its time to reanalyze your offer. 3. The Message
Is your message clear and distinct from your competitors? Remember our little yellow pages exercise? Did you see how the advertisers messages blended? Uniqueness was hard to find, wasnt it? When you compare your message to that of your competitors, you are not doing it to put yourself at your competitors level. Your task is to identify the boring monotone of your competitors, and stay as far away from it as you can. Your job is to always have the most powerful and unique message one that is transmitted to your target market in a consistent basis. 4. The Technology
Are you keeping up with the latest technology, research, customer service applications, marketing techniques, and everything else that keeps your business ahead of your competition? Once again, your goal is to stay a step ahead of the competition, not to emulate it. Knowing the capabilities of your competition helps you keep your feet on the ground, and running the good race. 5. The Good And The Bad
Here is information that will help you propel your business forward in huge leaps; but only if you are honest with yourself. Whats your competition doing well? How does it compare to what you are doing? Put your ego aside and strive to truly learn from your competitors. By the same token, take a close look at their errors. It will give you a clear picture of their weaknesses; and therefore, a powerful tool to help you fill those gaps with your enhanced services. 6. The Perceptions
The short definition of marketing is managing perceptions. As you know, perception is often more powerful and real than reality itself. Its my belief that to a great extent, the winners are those that manage perceptions better. How are your competitors perceived in the marketplace? How are you perceived? This type of analysis helps you differentiate your business from your competitors. Managing perceptions must be your goal as you develop and apply your marketing efforts. As you study your competitors, remember the reason for doing it Its to establish your differentiation over them. Obviously, you need to use common sense as to the degree of differentiation you want to achieve in the marketplace. However, as a rule of thumb, the more distinct you are from your competitors, the better. Do not forget to look at other industries, and how they market. You will be surprised how much you can apply to your own industry. Your distinction must show in the way you market your business, the way you conduct your business, and the way you service your customers. Remember, its not enough to have a Unique Selling Proposition; your whole approach must be unique. Franchise Agreements and Conditions of Transfer

By Lance Winslow In modern day franchising there are often situations where a franchisee, which is an individual or a franchisee, which is a corporation will wish to sell their rights under the contract to another party. A franchisor has to pay attention to these things to insure that there is no illegal or inadvertent transfer of confidential proprietary information such as secret recipes, operations manuals or marketing methods. Indeed this stands to be reasonable to wish to monitor it, however it is not nearly as easy as it sounds as many deals, appear to be cut and dry or black and white can quickly become rather convoluted. It is so easy to accidentally allow information to slip your grasps and always difficult to control. Then there is the occasional competitor who will attempt to legally attain your secret information thru owning interests in one of your franchised outlets. How do I know, well it happened to me. So, I added this expanded clause to our franchise agreements to prevent this in the future; 5.2.4 Conditions to Transfer In connection with any transfer provided for above (which requires Franchisees consent), the following requirements must be met to the full satisfaction of Franchisor as a condition to any transfer: (a) The proposed transferee or its principals must meet Franchisors reasonable requirements for experience, net worth and character, as applied by Franchisor on a nondiscriminatory basis in selecting new Franchisees and must have or obtain before transfer all licenses required by law for operation of the Franchised Business. (b) The proposed transferee or its designee must attend and satisfactorily complete Franchisors initial training. (c) The proposed transferee (and each partner, member or shareholder) must have duly executed an agreement to be bound by, and to assume and perform all the duties of the Franchisee under, the Agreement (including, in the case of such partners, members or shareholders, the covenants not to compete required by Section 3.20). (d) All maintenance, repairs and renovations required to bring the Franchisees premises into compliance with Franchisors standards must have been completed. All maintenance, repairs and upgrades required to bring the Franchisees mobile units and equipment into compliance with Franchisors standards must have been completed. (e) All monetary obligations of Franchisee under this Franchise Agreement are fully paid and Franchisee and each of its partners, members, shareholders, officers and directors must execute a general release of any and all claims against Franchisor and its affiliates and its predecessor, sister or co-brand companies and their shareholders, officers, directors, employees, agents and their spouses. (f) Franchisee agrees to remain liable for all obligations to Franchisor in connection with the Franchised Business prior to the effective date of the transfer and must execute any and all instruments reasonably requested by Franchisor to evidence such liability. (g) If the transfer results in more than a fifty percent (50%) change in the beneficial ownership of the Franchised Business, then the transferee must execute the then current form of the Franchise Agreement, except that the initial term will be the same as the remaining term of the original Franchise
Agreement. (h) The transfer fee specified in Section 2.4 must have been paid in full. (i) Franchisee must offer the Franchised Business to Franchisor in writing for the right of first purchase. (See Section 5.5 of this Franchise Agreement.)
Before the effective date of a transfer Franchisor approves: (a) Franchisee must agree to remain bound by the covenants in this Franchise
Agreement to not compete against Franchisor and to not disclose confidential information. (b) Franchisee will pay all ascertained or liquidated debts concerning the
Franchise. (c) Franchisee may not be in default under this Franchise Agreement or any other agreement between the parties. (d) Franchisee will pay Franchisor or a registered and approved business broker, which
Franchisor may have at the time of the transfer, a ten (10) percent commission on the gross transfer price (excluding the price of real property), if Franchisor obtains the transferee for Franchisee.
Any transfer by Franchisee must be approved by Franchisor in writing. The transferee must execute the standard form Franchise Agreement then being offered to new System Franchisees and such other ancillary agreements as Franchisor may require for the Franchised Business, which agreements will supersede the original Franchise Agreement in all respects and the terms of which agreements may differ from the terms of this Franchise Agreement; provided, however, that the transferee will not be required to pay the $20,000 Initial Fee and the Marketing Area provided for in this Agreement will remain the same. -- --- ---- ------ ---- --- -- If you own a franchised outlet this is something you might consider and it would be smart to talk with an experienced franchise attorney who specializes in franchising to do an audit of how you are legally protecting your proprietary information.
